My guess. The missing part on the bolt is letting the case drop off the boltface before it gets to the ejector. Need to replace the bolt body. If it were simply the ejector you would have to pull the spent case off the bolt....lot more than just turning the rifle over and shaking it. Just a guess.

Update: first thanks for all the help, got a replacement bolt body, fitted all my bolt pieces into the new body. feeds and ejects good. purchaced a field head space guage and it will not close on it. Took it to the range today, made sure no one else was there, rigged it up to shoot out of my lead sled with a long string with sand bags over the receiver. Failed to fire, upon further inspection firing pin not making contact with primer not even a light strike, using a heavy spring out of a military bolt, firing pin protruds bolt face by a good margin when all apart and slidding it in and out by hand. Anyone have any thoughts? Are there any known variations in 98 firing pins?

There are at least two types of Mauser 98 firing pins. A M48 Yugo won't work in a Gew 98.

Are you certain you assembled the bolt correctly?
-
Yes, bolt was put together correctly. cocks on close, dry fire and it clicks. with bolt removed from receiver and in the resting position the firing pin is protruding the bolt face by a fair amount. I dont see how it could not be firing. I guess the next step would be how far the firing pin is protruding the bolt face

I had a so called "gunsmith" re-assemble a Mark X bolt that way. Fortunately he was only doing cerakote. I would dis-assemble it and start over.
