I just picked up my brand new 1895 Guide Gun in 45-70, got it home and the lever won't stay latched. I am sure its something simple, but it's brand new and I don't really want to disassemble it. Has anyone else had this problem with their Marlin?

The finger lever plunger spring may be broken, bad, or not there at all.Call Marlin, if it has to go back to them they pay the shipping both ways.Or they may send you the parts.

Mine does it too. I haven't yet figured out how to repair it, and it shoots fine.

No, I've never had that problem. Usually, the problem I have is the exact opposite. I have to take two turns off the lever latch spring to get the action to the point where it's usable. If you bought it from a gunshop, take it back and have their smith fix it. If not from a gunshop, contact Marlin.

One other thing to look at:
There's a remote possibility that there's a small burr on the socket of the detent plunger. Sometimes, the plunger gets pushed in from the lever being closed and the plunger can/t/won't pop back out.

I talked to Gun shop and they told me to bring it back and their gunsmith would take a look at it on Monday. If he can't fix it or thinks its a manufacturing defect he will send it back to Marlin for repair or replacement.
