In dismissing the lawsuit, Judge Barbara Bellis wrote (http://civilinquiry.jud.ct.gov/DocumentInquiry/DocumentInquiry.aspx?DocumentNo=11214676) in her decision that "Congress, through the Protection of Lawful Commerce in Arms Act (PLCAA), has broadly prohibited lawsuits 'against manufacturers, distributors, dealers, and importers of firearms...for the harm solely caused by the criminal or unlawful misuse of firearm products...by others when the product functioned as designed and intended."

Finally, the plaintiffs also cannot avail themselves under the Connecticut Unfair Trade Practices Act (CUPTA) to bring the lawsuit within PLCAA's exceptions. Under CUPTA, a plaintiff must allege a consumer, competitor or other commercial relationship with the defendant. In the current case, the plaintiffs did not allege any such relationship.

Connecticut Gov. Dannel Malloy issued the following statement:

“While today is a deeply disappointing day for the families, their appeal will continue this fight for justice. As I have stated before, the laws providing unique protections to gun manufacturers need to be changed to give crime victims a right to pursue legal remedies.”

The laws are there for this exact reason. A manufacturer is not liable for how someone uses their product. The plaintiffs should be forced to pay Remington's legal fees. The firearm industry is a massive target, no pun intended, for these type of suits. That's why they have specific protection.

and that right there is why the liberals don't get it, did the gun manufacture,distributor or dealer commit the crime? no it was the perpetrator of that horrendous act, not those listed in the suit.

Good news, I expect Hillary might try for some sort of "adjustment" in the lawsuit protection rather than an outright repeal. Hopefully at least one house Congress will demonstrate common sense and protect an industry intentionally targeted by anti gun forces in order to wear down industry with lawsuits.

Even Bernie at one time said it seemed stupid to allow hardware stores to be sued for what customers do with a hammer lawfully sold by the store.

That's the rub. It's a slippery slope to go down. It would set a precedent for suing manufacturers of all products. Imagine how many suits the auto industry would face because of every accident. After all, it's not the driver's fault. All fault would lie w/ the manufacturer.
