Its not a nfa item.
They made two different ones.
One has a barrel less then 18 inches which make it a sbs or aow
The other is this one.
18 inch barrel makes it a standard title I firearm.

Don't forget the overall length requirement -- 18 inch barrel, 28 inches overall length. The action and grip on that look shorter than ten inches (and if that 18 inch barrel turns out to be 17.95 the way a BATF agent measures it, someone has trouble either way).

Edit to add: I notice the chambering stamp for the upper barrel says ".22 S, L, LR & N.R.A." Google doesn't seem to know there was ever a .22 N.R.A. cartridge; was this a special loading used in N.R.A. competition events, or something else entirely?

The atf can measure it anyway they want to.
Its 18 inches.
They made 4 models. 12", 15", 18", 18½"
The 18.5 is the one currently produced now.

Wiki has some great info -> http://en.wikipedia.org/wiki/Marble_Game_Getter

Original Model 1908 and Model 1921 models produced before 1943 are Curios & Relics under US law, but are still subject to the provisions of the NFA if their barrels are less than 18" in length; the 18" barrel variation was administratively removed from the NFA in 1939 by the Bureau of Internal Revenue after determining that it was not concealable on the person

I am still not sure what its worth.
I am gonna guess about $1200 or so.
I am not sure thought...
