If a .35 Whelen will fit at all, it should feed. I like the big chrysanthemum safety too.

The 35 Whelen has the same cartridge length as the 30-06. With a Type 99, you maye have to deep seat the bullet to fit the magazine box but the Type 99 that I have rechambered for 7.7-06 feeds with no issues the longer 06-case as long as I don't try to load the bullet with a long shank visible.
Why don't you look at rebarreling with a 358 Winchester (35 caliber bullet, 308 Winchester parent case) barrel so you have plenty of magazine box length with the 7mm shorter case and that way you can seat the bullets out long enough to meet the rifling if you need it.

According to Hornady Manual, the Whelen Max COL is 0.2 longer so that may or may not be an issue for your plans.
I love the Type 38/99 palm safety.
