CA 10 day wait ruled UnConstitutional!

Well,,, sanity finally has prevailed here in the Golden State. The 10 Day Waiting Period to receive a gun after you purchase it has been struck down by a District Court Judge.

The ruling states that if you already own guns then you don't have to go thru the wait or the background check, since you have already been deemed fit to own a gun.

If this is your first gun then you still will have to wait 10 days for them to do the background check.

I have bought several guns this year. I had to wait for 10 days to pick everyone of them up, which was pure BS since I am a Law Abiding Citizen and not a Criminal or Gang Member.

The judge stayed the execution of the strike down for 6 months to give the state a chance to fix the law and to comply.

Now all we have to get shot down is the "Handgun Safety List" and the Lead Boolit Ban, neither of which are on very solid ground. The first to go should be the Hand Gun List, since by the end of this year there won't be much of any new guns that are salable here, as they all will have fallen off the list after 5 years.

Outfits like Ruger, S&W, Glock have all agreed not to renew the certifications for their guns to force the state to drop this idiotic regulation. Not a Law but a Regulation.

Pretty soon you can all move back!

    Randy

Even if you got those things overturned, I still wouldn't want to go live in the land of fruits and nuts. There's a lot more wrong with California than just the gun laws.

    USAFrox,
No state will ever have laws that please everyone, Texas included, but I won't disparage them, unlike those who do such to California and its residents. Some of us live in states that we'd prefer not to, but life's circumstances times often dictate otherwise. So here I am in California.

Yes, slowly but surely, some of California's anti-gun laws are being ruled un-Constitutional. It took many decades for those laws to be enacted, and it will take time to un-do them. In the mean time, denials for concealed carry permits have been found to be in violation of the Constitution, but the decision is under a seemingly unlawful appeal. In all probability, the ruling will stand. San Francisco's magazine ban is no more. Now, the invalidating of the 10-day waiting period. It's all good news.

And, look what happened in Illinois.

Yes, the state blows/sucks and I agree. But criticism from outsiders ain't cool. Because I don't criticize others and their states, I expect the same from them. Perhaps, I expect too much.

Beside, those who live in the other 49 states ought to learn from California. Learn the evils of socialism and how it degrades society. Learn how there isn't any pie in the sky. Learn how looking through rose colored glasses blinds one to reality.

I apologize for the thread drift, but don't like disparagement.

It's good to see a bit of ground being gained back there. Hope for more to come. These kinds of things are good news to me wherever they happen.
Too bad about the unlawful appeal on the carry issue though.

I used to live there. I had enough. I moved. Am I still ineligible to criticize according to you? Is that a right reserved for foreign interests only? Give it up.

The judge ruled the 10 day waiting period unconstitutional and immediately instituted a 6 month waiting period before it goes into affect. I've lived with the waiting period my whole adult live. Call me a cynic, but I will believe it after it really goes into affect. The libs will find a way around the ruling or just just come up with something different.

I live in Illinois and it is worse than California in some ways. Born and raised here. My family and my life is here. Stuck with it. Just keep trying to make it better.

Most Californians that feel this state "blows" live in Southern CA. or the S.F. Bay area. They are right as those areas keep electing the idiot liberals as state law makers. Us Northern CA. guys have far more freedom and would love to make N. CA. a separate state. In my county and the surrounding counties all you need for a CCW is to state you want it for "personal protection" and fill out the paper work and complete the test. Pay your fees, that 90% goes to Gov. Brown and be on your way. I even have a 40 yard pistol range at the back of my house. Pays to live in a rural area.

Heck, the last time I bought a handgun there, I had to wait fifteen days to receive a handgun and ten days for along gun, and I was a Federal Agent waiting fifteen days for my new duty weapon. When I went to the dealer to do the paper work and pay for the Sig, I was in uniform and carrying a gun. I knew the dealer was going to tell me about the fifteen day wait before I could take possession, and when he did, I looked down at the gun on my hip, then told him that I carried a Class III automatic rifle every day, and said, "How much sense does this make?"

Apologetically he told me that it somehow kept the politicians happy.

It's a nice place to visit, but I wouldn't want to live there again. Ten and a half years was enough.
There is some ammo and more ammo. There is never enough ammo!

I am with you on this one. Wish you could get a military pistol with a C&R again.

So, does the fact that I lived there and my second son was born there allow me to criticize California, or is it your policy that no one is ever allowed to criticize your beloved land of fruits and nuts?

No we allow Texans to criticize California since we know why Texans wear big belt buckles.

I recently went through the criticize-your-state thing with a relative. He started going on about how horrible Oregon is and how much he hates it as a state. My response was to ask him to go ahead and criticize the nuts running the state from Salem, the lunatics voting for them in Portland (heck I'll agree with you even), but please lay off the rest of the state some. We have plenty of good folks here (a minority maybe, but still plenty), it's a beautiful place to live, and it's my home. It's frustrating that it's so "blue" and taken over by wackos, but it's still my home.

I get the feeling that that's all some of our Californian friends here are asking for as well; just a little bit of respect for their home. It's not ALL bad there.
