I was sorting through some brass and found some 40s that have flute marks on them similar to what I would expect to see on .308 brass fired out of an H&K rifle.

have to be a sub gun.
i'd guess european manufacture.
MP5 in .40 S&W. Coharie Arms produced an SP89 and an HK94 clone in 9mm and .40 S&W. Both will flute your brass.
