Tucson leaders look to tighten gun ordinance

TUCSON, AZ (Tucson News Now) -
Tucson city unanimously passed an an updated amendment to its ordinance restricting the city's gun ordinance covering the Tucson Convention Center on Wednesday, July 6, at the council's study session.


In 2013, the city passed an ordinance which requires gun sales on city property to be subject to background checks.


It effectively ended the traditional gun shows and sales at the TCC. None has been held there since 2012.

The new restrictions to the present ordinance "would add a requirement that would prohibit the sale of any weapon, .22 gauge or larger, that is capable of firing 10 or more rounds without reloading, and/or the sale of any clip or magazine that is capable of holding 10 or more rounds of ammunition."


The restrictions are supported by Ward 1 Council member Steve Kozachik and Ward 3 member Karin Uhlich.


"We're just simply seeking to be sure that our venue, the Tucson Convention Center be managed appropriately and reflect the will of the people of Tucson," said Uhlich.


But the new restrictions may not be all they seem.


The state legislature passed Senate Bill 1266 in this legislative session and Gov. Doug Ducey signed it in May.


The bill prohibits Tucson or any other municipality or county from passing any and all gun laws or restrictions.


A violation calls for a $50,000 fine.


City leaders met in executive session last month to discuss options and to look for a way to challenge the ban.


But Kozachik says the ordinance amendment, while it may provoke the state, that is not the intent.


"This is beyond symbolism, he said. "This is a statement of principle that this governing body has not only the right but an obligation to embrace," he said.


But it goes even deeper still.


State lawmakers also passed SB 1487 which the governor signed in March.


It states Tucson, or any other municipality or county government cannot pass a law or ordinance which is "in violation of state law."


Any lawmaker can ask for an Arizona Attorney General investigation and if found guilty, the penalty is withholding state shared revenues.


In Tucson's case, that could be millions of dollars.


But Tucson is confident it will prevail as it has in recent state challenges to its election laws.


Tucson is a charter city which gives it considerable leeway to determine its own destiny without interference from state government.


The city feels confident it will win the case.


When it passed the ordinance in 2013 there were threats from lawmakers but no lawsuit or challenge materialized.

Love to see a challenge on their 22 gauge language as that would be actual case
size 12 gauge is larger than 22 gauge or numerically 20 gauge is larger than 22 gauge. But of course they think they mean caliber. God the City Attorney must be an idiot not to stop their feel good legislation. If the decimal on Gauge is correct (0.22) gauge that would be what???

Am I reading this right. They passed an ordinance that said any gun sold on city property in 2013 had to have a background check on the buyer. The gun show organizers quit using the city property, and NO gun show has been held there since (Hmm sounds like a stupid revenue costing move to me, but what do I know) Now since they passed a law, and nary a gun has been sold there since 2013, and NO plans to ever sell another one there, they spend their time thinking up how to put harsher restrictions on NOTHING, against state law, which could cost them 50,000, or the state revenue they live off of, or at the very least a court battle, just to pass a feel good law that pertainss to exactly NOTHING. Da dems sire have their own way of thinking, and it doesn't matter what state they are in.

Artful - that doesn't surprise me a whole lot as it's been an issue in Tucson for a while. Our place is in Sahuarita so we are just south of the city. It always get's me how they are speaking "fro all the citizens of Tucson" . . . hmmm . . . I doubt that. Before they take all of this on, perhaps they should take on the corruption within the municipal government? Taxpayer's money being misspent . . . contracts not being lived up to, etc.?

Your statement on the AZ cities is correct. Funny how Tucson is so worried about this issue but they don't do much about the hundreds of homeless (which took over the downtown area last year during the Gem Shows) when all the outsiders come to town and bring boo coo bucks into the local economy during the month of February . . . or the gang activity . . . . or the rampant drug problem? Guess it's a matter of "political correctness" and "social class issue"? (An I am not blaming Law Enforcement for not taking care of the problems . . . they have budgets and "political parameters" to work within.

Or . . . . . perhaps they thin that by banning gun shows at city facilities will "end" such problems? After all, isn't this what most of those who sit on the Left think . . . . ban things for law abiding citizens and it will solve the problem as the criminals will certainly abide by the same rules? Horse puckey!

I'm licensed in AZ to carry (even though you are not required to be licensed) and I carry often . . . especially when I am going in to Tucson. I have been confronted twice in parking lots within the city by "pan handlers" who are insistent on the fact that you are going to give them money (both were homeless, you could smell the alcohol and both appeared to have some mental issues) . . . . fortunately, neither confrontation escalated and I was able to distance myself and put an end to the confrontation. I also was walking down a sidewalk one day . . . a young woman was coming towards me and I ended up taking her to the ground as a car drove by (a busy street) and let off a number of rounds out the window. It was loud enough that my wife and several business owners came out of nearby stores to see what was going on as they had heard the shooting. But I'm sure such things can certainly be stopped by the city fathers prohibiting gun shows on city owned property . . . which is paid for and supported by the citizen taxpayers . . . notice I said taxpayers as we won't even go in to the illegals and drug dealers who don't pay taxes. Again, I don't blame the LE establishment. If the tree hugging left wants to make the city "safer" . . . then stop wasting the money and put it into the LE budget, hire more officers and "clean up Tucson" . . . but good luck with that . . . . as hard as Border Patrol works the border is still leaking like a sieve and 19 is still a main artery to move contraband north. Just saying . . . . .

It will be interesting to see how this plays out. I'm hoping that the state comes down on them like a load of bricks and cuts off the revenue sharing . . . . last time I knew, Tucson wasn't in Kalifornia but perhaps they moved the boundary lines when we weren't looking? Never know I guess . . . .

God... It's getting bad... If HC wins that's the beginning of the end or the beginning of another revolution... for those who still have the right to keep and bear arms. GOD BLESS AMERICA!

I met Stevie K. at a REPUBLICAN shindig several years ago - he was trying to get into politics, and the Rep community wouldn't have anything to do with him, so the Dems welcomed him with open arms. I guess his philosophy is 'Whatever the money folks want, I want, and will do'. We have a fairly corrupt city government here that do what corrupt governments do - they cater to 'ism's' and stuff that gets publicity, does little to support most citizens, but buys them votes.

The shows at the Convention Center were pretty lame, anyway. But it is annoying how a select few people can go against everybody else and get away with it. It only took three Supervisors to kibosh the Pomona Gun Show, and the City had to fork over many dollars to subsidize the Fairgrounds for the revenue loss. Since they were Taxpayer Dollars, they were cheerfully given. This deal is likely to be the pretty much the same--a giant Kabuki Theater of fussin', fightin', well-compensated Lawyers for City and State arguing over the Issue, all paid for by us.
