INFORMATIONAL ALERT - What's in the CCW Bill?


The concealed carry bill, HB0183 (as amended), which passed through the Senate and House by overwhelming majority, is now waiting for Governor Quinn's signature. Please keep in mind that the Governor has not signed the bill, it is not yet law. He still may Veto the bill, or he may use an Amendatory Veto. Since no one knows what the Governor will do, the synopsis of the bill will not be valid if the Governor vetoes it or uses an Amendatory Veto. Many of you have been asking what the bill contains - below is a brief outline. This synopsis of HB1083 is not legal advice.

Regulations:

One statewide shall-issue licensing standard.
With regard to concealed carry licenses, preempts local authority of governments to regulate handguns and ammunition for handguns, including licensing, registration, and transportation.
With regard to FOID card holders, preempts local governments from regulating the transportation of all firearms and ammunition.
Not preempted are AWB enacted prior to or within 10 days of the enactment of this legislation - after that date, new AWBs would be preempted. Local governments could still regulate rifles and shotguns, but not handguns.
Grants "safe haven" protection for people carrying concealed while in their vehicle even in prohibited areas.
Upon exit from their vehicle, the firearm must be locked in their vehicle. If they wish to lock their firearm in their trunk, it must be unloaded before exiting the vehicle.
License to be issued by the Illinois State Police.
$150.00 fee for 5 years.
Requires 16 hours of training, including range time. Up to 8 hours of credit will be recognized for those who had hunter safety, was honorably discharged from the military, or had other CCW training. At this time, states with shorter training time, such as Utah, may only be credited 4 hours. The administrative rules of what the allowances will be, have not yet been determined.
Private property owners can post their property prohibiting concealed carry. "Safe haven" still applies to their parking lots.
Restaurants with 50% or more of their receipts from food, but still serving alcohol, are legal to carry in, but are still subject to private property posting by the owners or operators.
Law enforcement may object to a person they believe to be a "clear and present danger" to themselves or others. Applicants can appeal that decision to the Concealed Carry Licensing Board.
The State Police have 180 days from the effective date of this bill to be set up to begin processing applications.
Within 60 days of the effective date of this bill, the Illinois State Police shall begin approval of firearm training courses and instructors.
There is no reciprocity, but "safe haven" applies to out of state concealed carry permit holders.

Prohibited Places: remember that "safe haven" applies to most of these places:

Property under control of an elementary or secondary school
Pre-school or child care facilities
Property under control of an officer of the legislative or executive branch of government, except DNR regulated areas where firearms are allowed
Courthouses
Libraries
Airports
Gaming facilities
Stadiums, arenas, sporting events
Amusement parks
Museums and zoos
Buildings under the control of local government
Jails and detention facilities
Hospitals and mental health facilities
Mass public transportation
Bars
Public gatherings, but walk through is allowed to get to your home, place of business, or vehicle
Places that have special event liquor licenses
Any public park, with an exception for walking or bicycle trails, if only a portion of the trail goes through the park. The walkers and bicyclists must stay on the trail
Colleges and universities and property under their control; they may develop their own rules
Any area where firearms are prohibited under federal law
Nuclear facilities ("safe haven" for the parking area does NOT apply)

The United States District Court has extended the June 8th, 2013 deadline for a concealed carry law to July 8th, 2013. Although I think the Governor will take action before that date, we just will have to wait and see what that action is going to be.

Thank you for this information BWB. Unfortunately too much blah, blah, blah. Really wish he would have fell asleep at the wheel and hit a bull, so as not to of postponed the bill signing. At least something is better than the only state with nothing.

Here I sit in a "Socialistic" governed country. The President claims to be complete commi and I have had CC for 15 years. My wife for a few years less.
Maybe one day ILLinois will catch up to past history. At least the ball is starting to roll.

I think he (Q) is stalling to give local Gvmt time to enact AWBs Before he signs it.

If he adds a bunch of garbage then signs it, is it a done deal or does it go back to the House/Senate for revote?

What we have on JELLOs desk is way better than what many other CCW states started out with.

Within 2-4 years folks will realize how much safer we are thanks to CCW and laws will be updated in our favor.

Remember it took 50 years of fighting Chit Kaga politics to get this far.

When it becomes LAW I am going to need major help changing my signature. It has stayed that way for so long the puter might just be frozen there. :bigsmyl2:

+1 on what Bad Water Bill said - not a bad law after all, and you WILL be able to
fix it later.

Two important reasons for CCW laws. First is the obvious, some good folks will
be able to protect themselves from bad folks. But the second is very important and
has been a major player in our steady recovery of our gun right is MOST of this country.
It puts hundreds of thousands of armed citizens on the streets and NOTHING BAD
happens. The antigunner's claims of crazy gun owners running wild and harming
people are PROVEN wrong, and this is EXTREMELY important as a foundation to build
on for recovering our rights. Plus, a lot of ordinary folks get to know some good
person that "carrys a gun". This is a long term attitude changer, in our favor.

You will be able to get it changed for the good in a few years. This is the start of the fall in IL.

The safe haven part is nice. I drive over there just about every day. I just leave the gun at home instead of taking it off and locking it up.

One thing missing seems to be a deadline fro processing applications. The issuing agency may choose to drag it's feet on applications making the process burdensome to the applicant.

Somewhere in all of the legalese IIRC the State Police have 180 days to issue or reject a license.

As usual there is NO penalty for non compliance. Last year my FOID card took 60 days BEFORE I called SOMEONE. Then 3 days to my door.

After 5 years you MUST pay ANOTHER $150.00 + more training to renew your CCW

Just received my UTAH NON RESIDENT CCW renewal notice. $15.00 to renew for 5 more years.

IIRC part of the $150.00 is to go for healthcare and???

In CROOK CO we have a $25.00 tax on all handgun sales. WHY??

To pay for the unpaid medical bills of GANGBANGERS that have been shot that is why.

In Illinois it is ALL about how much $$$ they can steal from honest folks to put in the pockets of politicians.

Fortunately some of our last governors get caught. IIRC it is something like 7 out of 10 got caught.

What other state would tolerate such nonsense?

My take on this law is that it is elitist. Consider that I want to protect myself on the street and live in Illinois. Need a gun, $400, Need training $300, Need a license $150.

If I were an Illinois resident I would get a CCW. Consider how many people live and work in high crime areas that could not begin to afford the close to $1000 fee. As was pointed out If you live in Chicago it will be higher. All this for a right to bear arms.

Elitist? Not Otis or many others of us that are ACTUALLY in this fight. Some of our army have to look for a ride to any meeting because a car is to expensive. Almost all of the names you see as ???? V Chit Kaga or Illinois are just plain down to earth still struggling to put food on the table folks. Yes I DO know several and have met most of the others.

I have been here fighting the machine for many years actually living in Illinois. I for one did NOT make remarks when others got CCW in your state FOR YOU but that is OK.

I would like to know how you are going to enjoy YOUR 2A rights WITHOUT a sidearm in ANY state? Most of the folks in high crime areas ALREADY have weapons or hadn't you noticed the high body count in Chit Kaga.

Training is still up for discussion. Several have started to put together programs for the needy. Stay tuned.

Yes the license fee is flat out gov robbery but after waiting almost 50 years to get this far we realize it may require another session of the GA to get that reduced and further refinements. Rome was not built in a day nor were YOUR state CCW laws advanced to where they are in only one session.

Now show me where in the law it states Chit Kaga WILL cost more?

Rant off from someone who is actually trying to make a difference and still live on a SS check only.

I lived there for 50 years. I think you missed my point.

Although IL ccw is a big step for Illinois gun owners, Illinois politicians still find ways to cut out 30% of the population, particularly low income rural and inner city people. They have made training and costs oppressive.

I have heard as part of the deal that the city of Chicago gun owners got an assault weapon ban.

Don't worry we're on the same side.

Did anyone hear Mark Levin the other night when he read the new ANTI GUN laws MOONBEAM was about to sign into law this week?

Almost every weapon will now be an ASSAULT WEAPON and you will need a special license to buy ammo or components.

Suddenly living in Illinois doesn't seem so bad.:bigsmyl2:

ALERT – Village Board Meetings with Municipal Gun Regulations on the Agenda - Monday, June 17, 7:30pm

Deerfield, Buffalo Grove trying to pass so-called "Assault Weapon" Bans



After the passage of IL HB-183 (amended to be CCW) through both houses of the Illinois Legislature, Rep Drury and Lt. Gov Sheila Simon have issued statements urging the passage of local firearms bans during a window of time provided for in the bill.

Simon and Drury are promoting bans on semi-automatic firearms that you own under the guise of "Assault Weapons". This would likely include popular sporting and defensive firearms like the AR-15, and standard-capacity magazines for all kinds of handguns and rifles. Law-abiding gun owners could face confiscation of their firearms or criminal prosecution.

At this time, Deerfield and Buffalo Grove appear to be considering new local ordinances at their next meeting on Monday. It is important that residents be there at these meetings to voice their opposition by addressing the board. If you live in either of these communities area, please go to that meeting. Be sure to arrive early to ensure that you gain entrance to the meeting. (suggested arrival: 6:45 pm)
