I would be inclined to add a little tin to make the lead run and harden just a smidge. 40-1 is great for such applications.

You will be fine with pure lead. When the 22 WMR first came out it had a 40 grain lead bullet lubed with wax and a muzzle velocity of 2,000 fps. The surface area of the boolit that is in contact with the bore is exponentially greater than that of a 40 gr 22 cal lead bullet. If you have good boolit fit and good lube, there will be no issues with using pure lead. You will not be able to push the boolit fast enough with a 38-40 to cause leading if everything is fitted and lubed correctly. I would only add tin if I was having trouble with the boolit not filling out properly.

For BP, pure will work. A little tin like 1# per 20# of lead will toughen the boolit a little to take rifling better. 1 to 30 is also good.
But your lube will be very important for BP so don't use smokeless lubes.
Glen at lasc.us at the bottom of the page here makes a wonderful BP lube.

I have a lo wall from 1898 that I shoot smokless in with a Lyman 40143 bullet. Your Marlin will handle ww bullets and smokeless with no problem.
